Timeline for a typical California Workers’ Compensation Case
Days 1-30:
Injury and Initial Filing
Key Event: Date of Injury

Days 1-90:
Claim Acceptance or Denial
Key Event:
90-day period for carrier to accept/deny claim. Investigation occurs; temp benefits possible. Outcome: accept, delay, deny.
Months 1 – 6+:
Medical Treatment and Discovery
Key Event:
QME/AME Evaluation resolves disputes on injury/treatment. Report guides settlement, care, or litigation decisions.
Months 6 – 18:
QME/AME Evaluation
Key Events:
Settlement via C&R or Stipulated Award. Unresolved cases go to WCAB trial. Appeals may extend timelines for complex claims.
Months 12 - 72:
Settlement, Trial, or Resolution
Key Events:
Settlement via C&R or Stipulated Award. Unresolved cases proceed to WCAB trial. TBI cases can last 3-6 years.
